Berenice in the Revue Droit&Patrimoine Insights into our practice at the crossroads of Inheritance Law and Business Law

The Revue DROIT&PATRIMOINE has entrusted us, as practitioners of business and inheritance litigation, with the coordination of a study on the crossroads and the uncertainties of these two disciplines, to which we have also contributed as writers.

It has just been published! You can access it here (for subscribers).

This has been an opportunity to surround ourselves with eminent public notaries, law professors and colleagues to discuss and bring their expertise on major issues we encounter on a regular basis during our practice:

  • The decease of a shareholder: five questions on the approval of heirs as shareholders” by Nathalie Levillain, Notary public in Paris
  • The continuation of a company following the decease of one of its shareholders” by Nadège Jullian, Professor at Université Toulouse Capitole
  • The taking into account of the changes affecting shares” by Jean-François Hamelin, Professor (agrégé) at the Université de Bourgogne, Director of the Business Law Master (Magistère de Droit des affaires)
  • The valuation of the donated shares for the purpose of the fictive reconstitution of the assets of the deceased: some recurring problems encountered by practitioners” by Victor Champey, Partner, Anne-Romaine de Grandmaison, Associate and Defne Caglar, Trainee Lawyer, for BERENICE AVOCATS
  •  “The valuation of shares in the event of the exclusion of a non-shareholder heir – valuation method and date” by Sarah Torricelli, Lecturer (Maître de conferences HDR) at Université Toulouse Capitole, Victor Champey, Partner and Léane Le Goff-Thakrar, Associate, for BERENICE AVOCATS
  •  “Tax implications of transferring a company following the death of one of the shareholders – is the Dutreil agreement still a (practical) solution?” by Michaël Khayatt, Partner and Jeanne Marcilhacy, Associate, for Arkwood SCP

We would like to extend our warmest thanks to all the contributors of this study for enriching it with their expertise and practice, and to the Revue DROIT&PATRIMOINE for giving us this wonderful opportunity to highlight the uniqueness and complexity of inheritance law, frequently at crossroads with company law.
